1. Purpose and Scope
This Timekeeping & Attendance Policy (the "Policy") governs attendance, Clock Events, meal-period records, Timecards, corrections, approvals, disputes, and related payment and billing workflows for Shifts arranged through the LuluCare marketplace.
This Policy applies to Healthcare Professionals, Facilities, Facility representatives, and other authorized Users involved in scheduling, supervising, recording, reviewing, or approving time. It supplements the LuluCare Marketplace Terms of Service, Healthcare Professional Agreement, Facility Services Agreement, Facility Pricing Addendum, Privacy Policy, Community Standards & Acceptable Use Policy, and other applicable policies.
Accurate timekeeping is essential to fair payment, lawful billing, marketplace integrity, and patient safety. All Users must provide complete, truthful, timely, and supportable records.
2. Definitions
For purposes of this Policy:
- "Assignment" means a Shift accepted and confirmed through the Platform.
- "Clock Event" means a Platform-recorded clock-in, clock-out, meal-start, meal-end, or similar timekeeping event. Each Clock Event is timestamped using LuluCare's server time at the moment the event is recorded, rather than relying on the device's local clock.
- "Geofence" means a configurable location boundary around a Facility, with a radius that may be set per Facility, used to help verify that a Clock Event is recorded at or near the Facility.
- "Scheduled Time" means the start and end time shown for the Assignment in the Platform, as properly modified by authorized Users.
- "Timecard" means the record of hours, meal periods, corrections, attestations, approvals, and related information for an Assignment. The Platform automatically calculates worked hours from recorded Clock Events and meal periods.
- "Approved Hours" means hours approved through the Platform or otherwise accepted by LuluCare after review.
- "Ready for Billing" means Approved Hours that have been finalized on an approved Timecard and staged for the Facility billing and Healthcare Professional payout workflow.
- "Healthcare Professional" means an independent healthcare professional using LuluCare to identify and perform Assignments.
- "Facility" means the healthcare facility or authorized organization posting or receiving services through LuluCare.
3. Attendance Expectations
Healthcare Professionals must treat confirmed Assignments as serious professional commitments. They must:
- review the Shift location, role, start time, expected end time, requirements, and instructions before accepting;
- arrive with enough time to report to the appropriate Facility contact and be ready to begin at the Scheduled Time;
- remain available for the scheduled Assignment unless released by an authorized Facility representative, an emergency requires departure, unsafe conditions justify leaving, or another lawful exception applies;
- promptly report delays, emergencies, illness, inability to attend, or other material attendance issues through the Platform or designated support channel;
- follow applicable cancellation and No-Show procedures;
- complete required handoff or departure procedures before leaving when legally or professionally required.
Facilities must provide accurate schedules, locations, reporting instructions, role expectations, and authorized contacts. Facilities must communicate cancellations, schedule changes, release decisions, and operational delays promptly.
4. Clock-In Requirements
Healthcare Professionals must personally record their own Clock Events using their own authorized Account and device unless LuluCare provides an approved alternative process. Each clock-in and clock-out is timestamped using LuluCare's server time.
A Healthcare Professional should clock in when present at the Facility, ready to begin the Assignment, and permitted to start work. Arriving at the property, parking lot, or surrounding area does not by itself establish that compensable work began.
Healthcare Professionals must not clock in early merely because they arrived early. Early work or an early Clock Event should occur only when requested or authorized by the Facility or when work is actually required and lawfully performed.
Facilities must not require Healthcare Professionals to perform work before clocking in or otherwise work off the clock.
5. Clock-Out Requirements
Healthcare Professionals must clock out when they finish all compensable duties, including any required handoff, documentation, or authorized post-Shift work.
A Healthcare Professional must not clock out before work is complete and then continue working. Facilities must not instruct a Healthcare Professional to clock out and continue performing duties.
If a Healthcare Professional remains at the Facility for personal reasons after completing work, the Timecard should not include that nonworking time.
6. Location Verification and Geofencing
The Platform records each Clock Event using LuluCare's server time and may collect device location information when a Healthcare Professional records a Clock Event. LuluCare may use this information to verify attendance, support Timecard accuracy, prevent fraud, investigate discrepancies, and resolve disputes.
The Platform may apply a location geofence around the Facility. The geofence radius is configurable and may be set per Facility. When a geofence is enabled, the Platform may evaluate whether a Clock Event occurs within the configured radius of the Facility and may flag, warn on, or record Clock Events that fall outside it.
Location verification is associated with specific timekeeping actions and is not intended to continuously track a Healthcare Professional throughout the Shift. Accuracy may vary because of device settings, building construction, network conditions, GPS availability, operating-system restrictions, or other technical factors.
Healthcare Professionals must enable permissions reasonably required for location-supported Clock Events. They may not use GPS spoofing, location-masking software, remote-access tools, shared devices, or other methods intended to falsify location.
A location mismatch or geofence exception does not automatically prove misconduct. LuluCare may consider all reasonably available evidence before making a determination.
7. Facility Wi-Fi and Connectivity
A Facility may provide Wi-Fi information or other connectivity support for operational convenience. The availability, strength, security, or reliability of Facility Wi-Fi is not guaranteed by LuluCare.
Healthcare Professionals remain responsible for attempting to record Clock Events promptly. Facilities should provide reasonable assistance when building conditions interfere with connectivity, but neither party may falsify a Clock Event to address a technical problem.
8. Failed, Delayed, or Offline Clock Events
When a Clock Event cannot be recorded because of a technical issue, the Healthcare Professional must:
- document the actual time work began or ended;
- notify the Facility contact and LuluCare as soon as reasonably possible;
- preserve relevant evidence, such as screenshots, error messages, messages, or other supporting information;
- submit a correction request through the Platform when available.
A delayed Clock Event should reflect the actual time work occurred, not the later time when the device or connection became available.
LuluCare may review server timestamps, location data, device information, messages, Facility records, system logs, and other evidence when evaluating a failed or delayed Clock Event.
9. Meal Periods and Rest Breaks
Healthcare Professionals and Facilities remain responsible for complying with applicable meal-period, rest-break, and workplace laws.
The Platform tracks meal periods through meal-start and meal-end events. Healthcare Professionals must accurately record meal periods when the Platform requires meal-start and meal-end events. They must not record a meal period that did not occur or omit a meal period that did occur.
Facilities must not direct Healthcare Professionals to work through a required meal period without lawful handling and accurate documentation. Facilities must not alter meal records to reduce payable time or avoid legal obligations.
A missed, interrupted, late, shortened, or on-duty meal period should be reported accurately through the available Platform process. Reporting a meal issue does not itself determine whether additional compensation is legally owed; LuluCare and the Facility may review the circumstances under applicable agreements and law.
Rest breaks may not require separate Clock Events unless the Platform or applicable Facility procedure specifically requires them. No User may falsify break records.
10. Timecard Attestations and Electronic Signatures
At the end of an Assignment, the Platform automatically calculates worked hours from the recorded Clock Events and meal periods, and a Timecard is presented for attestation.
The Healthcare Professional applies an electronic signature to the Timecard, attesting that it accurately reflects:
- time actually worked;
- meal periods taken or missed;
- corrections or exceptions submitted;
- the Facility location and Assignment performed;
- any early release, extension, or material schedule change.
An authorized Facility representative also applies an electronic signature to the Timecard as part of review and approval. A completed Timecard therefore carries the electronic signatures of both the Healthcare Professional and the Facility. An electronic signature, checkbox, in-app action, or similar confirmation may serve as an attestation.
An attestation or electronic signature must not be completed by someone who lacks personal knowledge or authority. No User may sign, approve, or attest for another person without authorization.
11. Facility Review and Approval
Facilities must review Timecards promptly and in good faith. Approval should be based on whether the record accurately reflects the Assignment and hours worked—not on unrelated disputes, performance complaints, or payment negotiations.
A Facility should approve, reject with a stated reason, or request a correction within the review period shown in the Platform or applicable Facility agreement.
Upon Facility approval, the applicable Healthcare Professional pay rate and Facility bill rate are frozen onto the approved Timecard record, the Approved Hours become "Ready for Billing," and a corresponding Healthcare Professional earning is created. Later changes to standard rates do not alter an already-approved record except through the correction or dispute process.
Failure to respond may result in LuluCare treating the Timecard as approved, escalating the record for administrative review, or taking another action permitted by the applicable agreement.
Facilities must identify authorized Timecard approvers and keep those permissions current.
12. Early Release and Sent-Home-Early Situations
When a Facility releases a Healthcare Professional before the Scheduled Time, the Timecard must reflect the actual time worked and the reason for early release.
Any minimum-payment, cancellation, reporting-time, or sent-home-early charge will be governed by the Facility Services Agreement, Facility Pricing Addendum, applicable law, and the circumstances of the Assignment.
A Healthcare Professional must not remain clocked in after being released unless the Facility requests and authorizes additional compensable duties.
13. Assignment Extensions
A Healthcare Professional may work beyond the Scheduled Time when requested or authorized by the Facility, when necessary to complete a lawful handoff, or when immediate patient-safety needs reasonably require continued service.
Extended time must be recorded accurately. Facilities must not pressure Healthcare Professionals to omit overtime or additional hours actually worked.
An extension does not guarantee that every additional hour was authorized for billing purposes, but LuluCare will not knowingly require a Healthcare Professional to underreport time actually worked. Billing disputes and professional payment obligations may be evaluated separately where permitted by law.
14. Timecard Corrections
A Healthcare Professional or Facility may request correction of a Timecard when a Clock Event, meal record, scheduled time, approval, or other entry is inaccurate.
Correction requests should include:
- the date and Assignment;
- the original entry;
- the requested corrected entry;
- the reason for the correction;
- supporting information when available.
Corrections must reflect what actually occurred. Repeated corrections, unsupported changes, unusual patterns, or material discrepancies may trigger additional review.
LuluCare may maintain the original record, corrected record, reason, supporting evidence, timestamps, and identities of approving Users for audit and dispute purposes.
15. Disputed Timecards
If a Healthcare Professional and Facility disagree about hours, meal periods, release time, attendance, or another Timecard issue, either party may submit a dispute through the Platform or support channel.
During review, LuluCare may consider:
- Clock Events and server timestamps;
- GPS, geofence, or location records;
- Platform messages and communications;
- Facility schedules, access logs, sign-in records, assignment sheets, or surveillance records lawfully provided;
- device, IP, and technical logs;
- attestations, electronic signatures, and correction history;
- witness statements;
- documentation from the Healthcare Professional or Facility;
- other reasonably relevant evidence.
Users must cooperate honestly and must not destroy evidence, pressure witnesses, retaliate, or submit fabricated information.
LuluCare may make an administrative determination for marketplace billing and payout purposes. That determination does not constitute a judicial, licensing, employment, or regulatory finding.
16. Billing and Payout Timing
Approved Hours are marked "Ready for Billing" and initiate the applicable Facility billing and Healthcare Professional payout workflow, as further described in the Payment & Payout Policy. Facility charges and Healthcare Professional payouts are staged by the Platform and released by a LuluCare administrator; no charge or payout occurs automatically.
A pending correction, dispute, fraud review, payment failure, or compliance issue may delay billing, payout, or final processing to the extent permitted by law and the applicable agreements.
LuluCare may pay an undisputed portion while reviewing a disputed portion when operationally available and legally appropriate.
Approval of a Timecard does not waive LuluCare's right to correct a duplicate payment, calculation error, fraud, or other material mistake.
17. Prohibited Timekeeping Conduct
Users may not:
- clock in or out for another person;
- allow another person to use their Account or device to record a Clock Event;
- record time not actually worked;
- intentionally omit time actually worked;
- falsify meal periods, breaks, signatures, attestations, corrections, or approvals;
- use GPS spoofing, location masking, remote access, or other tools to defeat verification;
- remain clocked in after leaving or being released;
- direct or pressure another User to falsify a Timecard;
- approve a record known to be materially inaccurate;
- withhold approval to gain leverage in an unrelated dispute;
- create sham Assignments or false hours;
- submit patient-identifying information through Timecard, correction, or dispute fields;
- alter screenshots, messages, photographs, or other supporting evidence.
18. Attendance Violations
Attendance-related violations may include:
- No-Shows;
- repeated avoidable lateness;
- bad-faith or repeated late cancellations;
- leaving without authorization or required handoff;
- failing to communicate a material delay or absence;
- accepting overlapping Assignments that cannot reasonably be performed;
- sending an unauthorized substitute;
- repeated failure to record or correct Clock Events;
- misrepresenting arrival, departure, or release time.
LuluCare may consider frequency, severity, notice, emergencies, reliability history, patient-safety impact, and supporting evidence when reviewing attendance concerns.
19. Investigations and Enforcement
LuluCare may place an Account or Timecard under review and may request additional documentation or explanation.
Depending on the circumstances, LuluCare may:
- require correction or additional attestation;
- issue education, coaching, or a warning;
- restrict accelerated-payout or other features where offered;
- pause future Assignments;
- cancel or reassign an Assignment;
- delay or adjust billing or payout where permitted;
- suspend or terminate an Account;
- recover overpayments or pursue amounts owed;
- notify an affected Facility or Healthcare Professional;
- report suspected fraud, abuse, or unlawful conduct to a payment processor, insurer, regulator, licensing board, or law-enforcement agency when permitted or required.
LuluCare may act without prior notice when reasonably necessary to address immediate safety, fraud, legal, security, or marketplace-integrity concerns.
20. No Retaliation
Users may not retaliate against a person for accurately reporting time, requesting a lawful correction, reporting a missed meal period, disputing a Timecard in good faith, reporting off-the-clock work, or cooperating with an investigation.
Knowingly false or fabricated complaints are not protected and may violate this Policy.
21. Records and Privacy
LuluCare may retain Timecards, Clock Events, location records, corrections, approvals, disputes, messages, and related evidence as reasonably necessary for payment, billing, tax, audit, legal, safety, fraud-prevention, and recordkeeping purposes.
Information will be handled according to the LuluCare Privacy Policy and applicable law. Users must not include patient medical records, PHI, or patient-identifying clinical information in timekeeping or dispute submissions.
22. User Responsibility for Device and Account Access
Healthcare Professionals are responsible for maintaining access to an appropriate device, protecting Account credentials, keeping device operating-system and location settings reasonably accurate, and promptly reporting suspected unauthorized access. Because Clock Events are recorded using LuluCare's server time, the accuracy of the timecard record does not depend on the device's local clock.
A lost device, depleted battery, disabled permission, or connectivity problem does not authorize falsification. Users must follow the correction process.
23. Changes to This Policy
LuluCare may update this Policy to reflect changes in the Platform, operational procedures, legal requirements, payment workflows, or marketplace risks. Material updates may be communicated through the Platform, email, or another reasonable method.

ACKNOWLEDGMENT
BY ACCEPTING OR PERFORMING AN ASSIGNMENT, RECORDING OR APPROVING A TIMECARD, OR OTHERWISE USING LULUCARE'S TIMEKEEPING FEATURES, EACH USER ACKNOWLEDGES THAT THEY HAVE READ, UNDERSTOOD, AND AGREED TO COMPLY WITH THIS POLICY.
